Terms of Use

Your use of SunnyDay is governed by Apple’s standard Licensed Application End User License Agreement. The following additional terms apply specifically to SunnyDay. By downloading or using SunnyDay, you agree to both Apple’s Standard EULA and these terms.

Eligibility

You must be at least 13 years old to use SunnyDay. By using the app, you represent that you meet this requirement and have the legal capacity to agree to these terms.

Health & Sun Safety Disclaimer

SunnyDay is not a medical device. It provides general wellness and educational information only. It does not provide medical advice, diagnosis, or treatment.

UV index readings, “good time to get outside” recommendations, and personalized vitamin D time estimates are informational guidance, not medical recommendations. You use this guidance at your own risk.

Always consult a qualified healthcare professional before changing your sun exposure habits, especially if you have a history of skin cancer, skin conditions, sensitivity to sunlight, or take photosensitizing medications.

Keith Carolus is not responsible for sunburn, skin damage, or any other health outcomes resulting from your sun exposure decisions.

Data Accuracy

SunnyDay relies on third-party data sources including Apple WeatherKit for UV index and weather conditions, Apple HealthKit for time-in-daylight records, and CoreLocation for your position. These are approximations and are not guaranteed to be accurate, complete, or up to date. Do not rely on them for safety-critical decisions.

Subscriptions

SunnyDay Premium is an auto-renewable monthly subscription. New subscribers may be eligible for a free trial period; after the trial ends, payment is charged to your Apple ID account. The subscription automatically renews unless you turn off auto-renew at least 24 hours before the end of the current period. You can manage or cancel your subscription in your App Store account settings.

Refunds

If you experience a technical issue, contact us at support@sunny-day.app and we’ll do our best to help. All payments are processed by Apple. To request a refund, please visit reportaproblem.apple.com. Apple reviews and decides all refund requests.

Third-Party Services & Affiliate Links

SunnyDay uses Apple WeatherKit, Apple HealthKit, and CoreLocation. These services are provided by Apple and governed by their own terms. We are not responsible for the availability, accuracy, or conduct of any third-party service.

The Balance section may contain affiliate links provided through CJ Affiliate (Commission Junction). Tapping those links may result in cookies or similar tracking technologies being used by CJ and the linked retailer. Our Privacy Policy explains this in more detail. Product information in Balance is not an endorsement or medical recommendation.

Disclaimer of Warranties

SunnyDay is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or uninterrupted service.

Limitation of Liability

To the maximum extent permitted by law, Keith Carolus shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to sunburn, skin damage, health outcomes, loss of data, or loss of profits arising from your use of or inability to use SunnyDay. Our total aggregate liability for all claims arising out of or relating to SunnyDay shall not exceed the total amount you actually paid us for SunnyDay in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Keith Carolus from any claims, damages, losses, or expenses (including legal fees) arising from your use or misuse of SunnyDay, your sun exposure decisions, your violation of these terms, or your violation of any applicable law.

Governing Law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law provisions.

Changes to These Terms

We may update these terms from time to time. If we make significant changes, we will notify you through the app or on our website. Continued use of SunnyDay after changes are posted constitutes acceptance of the revised terms.

Privacy Policy

Your use of SunnyDay is also governed by our Privacy Policy.
